These Terms of Service (“Terms”) govern your access to and use of the website bugshieldusa.com (the “Site”) operated by BugShield USA (“BugShield USA,” “we,” “us,” or “our”). By accessing or using the Site or contacting us through it, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Nature of Our Service

BugShield USA operates a free referral service that helps homeowners connect with local, independent third-party pest control providers. We do not perform pest control services ourselves, do not employ the providers, and are not a party to any agreement you enter into with a provider. All providers are independently owned and operated.

2. No Warranty; Homeowner Responsibility

BugShield USA does not warrant or guarantee any work performed by any provider. It is your responsibility as the homeowner to verify that any provider you hire holds the license, bonding, and insurance required for the work being performed in your area, and to satisfy yourself as to the provider’s qualifications, pricing, and suitability before engaging them. The Site and all content are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

3. Photographs and Depictions

All persons depicted in any photo or video on the Site are actors or models and are not providers listed on or connected through the Site. Images are for illustrative purposes only.

4. Service Availability

Same-day, next-day, and 24/7 emergency services are subject to provider participation, location, technician availability, and demand. Availability is not guaranteed and may vary by market and appointment capacity.

5. Consent to Be Contacted

By providing your contact information or calling a number listed on the Site, you consent to be contacted by BugShield USA and/or the independent providers we connect you with by telephone, text message, or email regarding your request, including through automated means where permitted by law. 6. Limitation of Liability

To the fullest extent permitted by law, BugShield USA and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Site or any services provided by a third-party provider, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).

7. Indemnification

You agree to indemnify and hold harmless BugShield USA and its owners, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your dealings with any third-party provider.

8. Intellectual Property

The Site and its content, including text, graphics, logos, and design, are owned by or licensed to BugShield USA and are protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works from the Site without our permission.

The Site may reference or link to third-party providers, websites, or services. We are not responsible for the acts, omissions, content, products, or services of any third party, and your dealings with any third party are solely between you and that party.

These Terms are governed by the laws of the state in which BugShield USA is organized, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Site will be resolved in the state or federal courts located in that state, and you consent to their jurisdiction.
